Nashua refuses monetary settlement with indie videographer after "false arrest"
« on: July 04, 2012, 04:00:02 pm »

Sponsor: http://MineThings.com - Sorry this report is a little self-centric. But many of you have been asking where things stand after NPD arrested me for "trespassing."  I was taken down in May 2011 as I tried to videotape outside Joe Biden's Radisson speech.  Subsequently we defeated the charge in court.  Then we filed a letter demanding compensation.  City of Nashua attorney Brian Cullen has announced that the city will not agree to any monetary settlement of the matter. His statement however specifically leaves the door open for a non-monetary amelioration of some kind.

In response I've had my lawyer Stephen Martin draw up a demand for the firing of the primary arresting officer, Denis Linehan.  Linehan was also the officer who groin-groped me unexpectedly as part of the patdown process.  In terms of the attorneys, Seth Hipple does my trial stuff, Martin from his firm does my lawsuit stuff.  I was impressed with and appreciate his willingess to pursue this "firing" demand. If successful, this kind of thing would not be to his firm's monetary advantage the same way a monetary settlement would.

Here's my video of the arrest

And here's a colorful new animated re-enactment of the incident.  One of my viewers produced it, YouTube.com/MrDrawingguy

Regarding the sponsor link above, did you know that the Mine Things game was designed by a free stater?  Deploy your armed robots on dangerous missions around the gutted earth.  Delegate to your AI units and decide how you want them to handle themselves against other players while you're away.

No need for modesty.  You are a hero, Ridley.  A living American hero.

Perhaps a public letter of apology from Donnalee Lozeau published in the Telegraph might be in order.

Nashua PD rejects demand for groper's dismissal

Update: Nashua PD rejects demand for groper's dismissal

Sponsor: http://LRN.FM - As you may recall, Nashua police arrested me while I was trying to film their actions outside a hotel in which Joe Biden was speaking.   In the process of searching me, the arresting officer Denis Linehan touched my genitals.  After our defeat of trespassing charges in court, my lawyer Stephen Martin has helped me issue a pair of demands.   If met, we would drop suit. The initial demand called for monetary damages in the $15,000 range.  When the city rejected that we represented that firing Linehan would be enough to prevent the suit.  As expected, city attorney Brian Cullen has rejected that offer too.   The city has however indicated a willingness to accept some other non-monetary settlement.

So...this is the part where we will either get creative and come up with something mutually digestible...or we carry on the fight in court.  I'm working up a couple of scenarios but could use your ideas.  What kind of settlement would Gandhi seek in a situation like this?  What would Rosa Parks have done?  How about Mike Fisher?

One idea I had was having the department officially change a policy or cease some anti-freedom activity that they normally do.  If there's something they could do that saves Nashua taxpayers some money that might also work.  An apology from one or more people would be another option to explore though maybe not sufficient.

Your thoughts?

I hate cops statists.

I doubt there's anything they would do that you could take as non-monetary compensation, so I'd probably just continue with the seeking of damages in my opinion.

Establish a $1K scholarship for the next 15 years for the best student essay on the importance of the first amendment or tell Cullen to piss off and sue the snot out of them so I can video the trial. BTW here's the latest on Kelly and various other bad cops in the area:

The video playlist is at
https://www.youtube.com/playlist?list=PL71E3DB20732E64ED&feature=view_all

I recently uploaded more episodes including the rest of the trial with subtitles, commentary and relevant file video. More video updates will appear there; more written updates will appear here.

Also the latest is that we've suggested city attorney Cullen present us with a counter offer.  He has apparently suggested that we make yet another proposal instead - LOL.  Cullen and I have met once and I was fairly impressed with the way he handled my ambush interview.  But bureaucrats never want to do any work heh heh.

I believe my lawyer Stephen Martin is probably encouraging him to take the next step at this point. That was my suggestion, but I think he would have done it anyway as we are of one mind.   Really am still impressed with the folks at http://NHLegalServices.com

Even if you're not one of their clients I recommend writing down their emergency number and keeping it in your wallet or your head.

I'm still interested in suggestions for a non monetary settlement, something outside-the-box that will actually bring a little more freedom to the people of Nashua my second-favorite city.   I have a fertile brain but have not come up with very many good ideas yet.  I know they are out there.

Chris thanks for wanting to tape the trial!

How about getting the dept. to set up a required class for all new hires on citizens' rights, specifically addressing open carry, video and audio recording, etc.?

I like this idea a lot.

I would still take the matter to court.  You can get a jury trial for a case like this, and enter the video itself as evidence.  You might also make note of the fact that you won your other case.
