State Trooper Lied in Court, Judge would not see video evidence

On Feb. 8th 2012 I was stopped in Whitefield NH.  The trooper stated the reason for the stop was speeding.  Because this was false she ended up "warning" me about my speed and giving me a inspection violation.  One of my two arguments was the stop itself (whether a terry stop was justified) and the fact that the vehicle could and did pass the inspection but due to faulty equipment used by the inspection station it failed the OBD test.  The car is now inspected and no work was needed to get the vehicle inspected (We just tried a different inspection station).

The Trooper in court stated she, "had me on radar", but did not have evidence proving this.  In the video she said she used the "Tracking History" to obtain my speed (being a van 50ft in front of me did not attempt to slow down when the road went from a 50mph to a 30 mph).  When I went in for the pre-trail conference I was given the option to not pay the fine and plea guilty.  Not caring about the $62.00 fine and more worried about the act of NH State Troopers stopping people under false claims. I chose to bring it to trail.  I am waiting to here back from an appeals lawyer about getting the transcripts and moving forward.  Given the information what do you think?

Well, it didn't look to me like you had done anything wrong, and I think that her "evidence" is a little shakey.  She also seemed a bit upset, but was clearly exerting some effort to keep that under the cuff.  Although I believe that many officers should be fired, I would have to write this one up under the "Not Fired" category.

In my trial, Officers Buccheri and Hersey lied openly in court, and both were caught lying to the jury under cross.  Both changed their stories, and people in court actually started laughing at Hersey under cross.

I found out that going to court is an "us vs them" type mentality and in no way do morals come into play.  I wish I could have had a jury (even if it was over something little) just to make the state pay out for all these non violent violations.  The state is very close to being bankrupt and if we keep making them spend money in court only to lose, I'm sure we will see a decline in these petty violations that no one in NH ever wanted in the first place.

My sentencing is tomorrow.  The prosecutor is asking for one year, which would be 8 months at the least.  All for acting in defense of my home and the people in it, harming no one, endangering no one.

It looks like there's already a bump in media attention.  Channel 9 just handled this this morning, running some stock footage.

At a minimum, this will be a good opportunity to get the word out about self-defense as an issue.
